Privacy, Communication & HIPAA Notice

We are committed to protecting your privacy and handling your personal health information (PHI) with care and in accordance with applicable privacy laws, including HIPAA where applicable.

 

1. Information We Collect

We may collect personal information that you voluntarily provide, such as:

  • name, phone number, email address, and messages submitted through forms or scheduling tools. This information is used only for scheduling, communication & administrative purposes related to services

 

2. Important Communication Limits

Website forms, email, and online communication tools are not designed for sharing sensitive clinical, diagnostic, or crisis-related information.

Please avoid submitting highly personal health information through unsecured channels.

 

3. Security of Online Communication

We take reasonable precautions to protect your information, but no website or electronic communication system can guarantee complete security. If you need to share sensitive clinical information, please use: phone contact, secure client communication systems  & in-person sessions.

 

4. Third-Party Services

We may use third-party platforms (such as scheduling tools or hosting services).

These services operate under their own privacy policies, and we are not responsible for their practices. We encourage you to review their policies when applicable.

 

5. HIPAA Rights (For Clients Receiving Services)

If you become a client, you have rights under HIPAA, including the right to:

  • access your records, request corrections to your records, request restrictions on certain disclosures & receive an accounting of disclosures when applicable

Requests can be made directly through the office.

6. Updates to This Notice

This notice may be updated periodically. The most current version will always be available on the website.

Court & Subpoena Policy

If Avowed Mind Behavioral Health or any member of its staff, including clinical staff and therapists, is subpoenaed, court-ordered, or otherwise required to participate in legal proceedings related to your care or your child’s care, fees will be charged for all time spent responding to such requests. Billable services may include, but are not limited to, preparation or review of records, preparation of written reports or summaries, consultation or communication with attorneys, travel time, waiting time, and participation in depositions or court testimony. These services will be billed at the current hourly rate of $200.00 per hour. Any court appearance will require a minimum fee of $1600.00 which must be paid in advance. Additional charges may apply for required court attendance, waiting time, or extended hours. Court documentation may take up to 14 business days or longer

Payment for anticipated legal services may be required in advance. Legal-related services are not covered by insurance and remain the financial responsibility of the client or the requesting party. If you are involved in a lawsuit, we may have to disclose health information in response to a court or administrative order. We may also disclose health information about your child in response to a subpoena, discovery request, or other lawful process by someone else involved in the dispute, but only if efforts have been made to tell you about the request or to obtain an order protecting the information requested.

Experiencing an emergency or crisis
